These Terms of Service (“Terms”) govern your use of the GO-BOSS platform (“Service”) provided by Eyeuniversal LLC d/b/a GO-BOSS (“GO-BOSS,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms. By clicking “I Agree,” creating an account, or accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. Your electronic acceptance constitutes a binding agreement equivalent to a physical signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the California Uniform Electronic Transactions Act (UETA).
1. SERVICES
GO-BOSS provides software tools for:
- CRM and pipeline management
- marketing automation
- AI-powered communications (email, SMS, voice)
- workflow automation
GO-BOSS is a technology platform only.
2. PLATFORM ROLE
GO-BOSS does not initiate, send, or control communications.
Customer is solely responsible for:
- selecting recipients
- determining timing
- message content
- obtaining all required consent
GO-BOSS acts solely as a software provider, not the sender or initiator of communications.
3. CUSTOMER RESPONSIBILITIES
Customer agrees to comply with all applicable laws, including:
- TCPA
- CAN-SPAM Act
- GDPR
Customer is fully responsible for:
- contact data and lists
- consent collection and documentation
- honoring opt-outs
- all communications sent using the Service
4. ACCEPTABLE USE
Use of the Service must comply with the Acceptable Use Policy (AUP) below, incorporated by reference.
5. AI AND AUTOMATION
The Service may include AI-powered or automated features.
Customer is responsible for:
- how AI tools are used
- ensuring communications are lawful and not misleading
- disclosing AI use where required
GO-BOSS does not control AI-generated content.
6. THIRD-PARTY SERVICES
The Service relies on third-party providers, including telecommunications carriers and email systems.
GO-BOSS is not responsible for:
- delivery failures
- message blocking or filtering
- outages or interruptions
7. OUTBOUND COMMUNICATIONS
The Service may be used for outbound communications where permitted by law.
Customer agrees to:
- target appropriate recipients
- avoid complaint-generating behavior
- include identification and opt-out mechanisms
GO-BOSS may restrict or suspend activity that creates legal or reputational risk.
8. FEES AND BILLING
- Fees are billed as agreed
- Subscriptions automatically renew unless canceled at least 30 days prior
- Fees are non-refundable unless stated otherwise
If payment is not received:
- Service may be suspended immediately
- Late fees may apply
9. MINIMUM COMMITMENT
If a minimum term applies, Customer remains responsible for all fees for the full term.
10. NO GUARANTEES
GO-BOSS does not guarantee:
- leads
- revenue
- conversions
- business outcomes
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
GO-BOSS liability is limited to fees paid in the previous 3 months.
GO-BOSS is not liable for:
- indirect or consequential damages
- lost profits
- regulatory penalties
12. INDEMNIFICATION
Customer agrees to indemnify and hold GO-BOSS harmless from any claims arising from:
- communications sent using the platform
- violations of applicable laws
- lack of consent
- misuse of data
13. THIRD-PARTY / AGENCY USE
If Customer uses the Service for third parties:
- Customer remains fully responsible
- Customer ensures compliance
- GO-BOSS has no relationship with Customer’s clients
14. RESTRICTED USE
GO-BOSS may refuse or terminate service for high-risk activities, including:
- unlawful lead generation
- deceptive marketing
- adult content
- gambling (where restricted)
- high-risk financial schemes
14A. COPYRIGHT AND DMCA COMPLIANCE
15. CHARGEBACKS
Customer agrees not to initiate chargebacks without first attempting resolution.
If a chargeback occurs:
- Customer remains liable for all fees
- GO-BOSS may terminate access
- Customer may be responsible for associated costs
16. SUSPENSION AND TERMINATION
GO-BOSS may suspend or terminate access immediately if:
- Terms are violated
- activity creates legal or reputational risk
16A. GOVERNING LAW
17. DISPUTE RESOLUTION
All disputes arising out of or relating to these Terms shall be resolved through binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in San Diego, California, in accordance with JAMS Streamlined Arbitration Rules and Procedures. The arbitration shall be conducted by a single arbitrator mutually agreed upon by the parties. If the parties cannot agree on an arbitrator within fifteen (15) days, JAMS shall appoint one. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorneys’ fees, unless the arbitrator determines that a party’s claims or defenses were frivolous, in which case the arbitrator may award reasonable costs and fees to the prevailing party.
Customer waives:
• jury trial
• class action participation
• class arbitration or any form of representative or consolidated proceedings
This arbitration provision shall survive termination of these Terms.
19. ENTIRE AGREEMENT
19.1 RELATIONSHIP TO SAAS AGREEMENT
If Customer has executed a separate Software as a Service Agreement (“SaaS Agreement”) with GO-BOSS, the SaaS Agreement shall govern the subscription relationship between the parties. In the event of any conflict between these Terms and the SaaS Agreement, the SaaS Agreement shall control.

This Acceptable Use Policy (“AUP”) governs your use of the GO-BOSS platform (“Service”).
Violation of the Acceptable Use Policy constitutes a material breach of this Agreement.

2. COMMUNICATION COMPLIANCE
Customers are solely responsible for complying with all applicable laws, including:
- TCPA
- CAN-SPAM
- GDPR
- CASL
This includes:
- obtaining proper consent
- honoring opt-outs
- maintaining records
Customers may NOT use the Service for:
Unlawful communications
- sending messages in violation of applicable laws
- contacting individuals without required consent
- using misleading sender information
- impersonating individuals or businesses
- making false or misleading claims
- generating excessive complaints or spam reports
- ignoring opt-out or unsubscribe requests
- distributing harmful, illegal, or abusive content
- hacking, reverse engineering, or disrupting the Service
- bypassing safeguards, limits, or security controls
- engaging in behavior that degrades platform performance
Customers may not use the Service in any way that:
- harms the reputation or deliverability of the platform
- creates excessive complaints or abuse reports
- exposes GO-BOSS to legal or regulatory risk
GO-BOSS may restrict or suspend activity that negatively impacts the platform, even if such activity is not explicitly prohibited above.
Customers are responsible for:
- all data uploaded or processed
- maintaining valid consent records
- complying with all privacy laws
If you operate in a regulated industry, you are responsible for compliance with all applicable laws and regulations.
The Service is not designed for storing or transmitting sensitive regulated data (such as payment card or protected health information).
GO-BOSS may, at its sole discretion:
- suspend or terminate accounts
- remove or restrict content
- limit access to features
- report violations to authorities
Serious or repeated violations may result in immediate termination without notice or refund.
GO-BOSS may monitor usage of the Service using automated or manual systems to detect violations and protect the platform.
